Imperial Tobacco Joins League, Files Case Against Australian Govt.

Imperial Tobacco Australia Ltd is the third tobacco company to knock the doors of the court for recent passed law which demands all cigarette companies to take off all the glamour associated with its packing to discourage people from smoking.

Imperial Tobacco Australia General Manager Melvin Ruigrok said recent laws which would get active from next year are totally unconstitutional and this is the reason they have filed a case against the government in the Australia's High Court.

Ruigrok said, "The High Court of Australia will now determine claims which include the validity of these unprecedented laws. Unchallenged, the Australian government would otherwise be able to simply take the intellectual property of legal entities".

The government has accepted the challenge and hopes to turn out as winners. On the other side, the third-largest company in the Australian tobacco market has said it is totally unfair means which the government is adopting to acquire intellectual property.

It seems the government is least affected by such comments and cases as it is quite determined to reduce the number of smokers from Australia.

With passing of this law which restricts tobacco companies to use logo and other advertisement matter, Australia would become first country to adopt strict packaging laws.

If the tobacco companies would go by the government then they have to lose billions of dollars, which they say they cannot afford.

Recently only the British American Tobacco Australia Ltd also filed a similar lawsuit against the government, though both cases differ in their application, they would be heard together by the court.

It is very important for Australia to come out as winners in this case as they have been looked upon by many different countries, like Europe, Canada and New Zealand, which take it as test case. If Australia turns out to be successful then they would also implement similar policies in their respective countries.
